Terms of Service

By registering or using CargaCell (hereinafter 'the Service'), you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any of these conditions, do not use the Service.

CargaCell is a website operated in Spain by Freddy Angel Poll Garcia that currently allows you to purchase top-ups for Cuban mobile lines. CargaCell is not a telecom operator and does not issue top-ups directly to Cuban lines. Top-ups are fulfilled through DT One, our service provider, which maintains the connection with ETECSA. Payments are processed through MONEI, our secure payment gateway.

To use the Service you must be at least 18 years old, or the legal age of majority in your jurisdiction. By registering you declare that you meet this requirement and that the information you provide is truthful and complete.

• You are responsible for maintaining the confidentiality of your access credentials.
• You must notify us immediately of any unauthorized use of your account.
• Account sharing with third parties is not permitted.
• We may suspend accounts that show suspicious activity or violate these terms.

• All prices are displayed in euros (EUR) unless otherwise indicated.
• VAT is not included in the price and will only be charged if the customer's billing country is in the European Union.
• Applicable service fees are clearly shown before confirming the purchase. Payments are managed through MONEI, our secure payment gateway. By making a payment, you also accept the terms of that service.
• Once payment is confirmed and the top-up is sent to the operator, the transaction is non-refundable except in the cases indicated in section 6.
• Prices may vary according to the exchange rate and destination operator fees.

We process refunds only in the following cases:

• The top-up was not delivered to the destination number due to an error in our systems or the provider's.
• The operator rejected the top-up and the funds were not applied to the destination number.

We do not process refunds if the phone number provided was incorrect or if the top-up was successfully delivered. To request a refund, contact us within 7 days of the transaction through our contact page.

CargaCell offers an internal wallet that allows you to save balance for purchasing top-ups on the platform. The following rules govern the use and management of said balance:

• Non-refundable: Unless required by law, balance loaded into the wallet is non-refundable to the user's bank account or payment method. This is due to management costs and possible bank or gateway fees. Any exception will be managed on a case-by-case basis.
• Expiration: The balance may expire after a period of inactivity of 12 months. 'Inactivity' is understood as the absence of transactions or account access during that period. Expired balance will be handled in accordance with applicable consumer protection regulations.
• Limited use: Wallet balance is only valid for purchasing top-ups on CargaCell. It is non-transferable, cannot be exchanged for cash and cannot be used outside the services offered by CargaCell.

The following are strictly prohibited:

• Using the Service for illegal, fraudulent activities or those that infringe third-party rights.
• Attempting to access other users' accounts or CargaCell's internal systems.
• Carrying out denial-of-service attacks, mass scraping or any action that degrades Service performance.
• Using payment methods that do not belong to you or that are fraudulent.
• Reselling the Service without express written authorization.

Non-compliance may result in the suspension or permanent cancellation of your account.

We strive to keep the Service available continuously, but we do not guarantee uninterrupted availability. Interruptions may occur due to maintenance, updates or causes beyond our control. We will not be liable for damages arising from the temporary unavailability of the Service.

To the maximum extent permitted by applicable law, CargaCell shall not be liable for indirect, incidental, special or consequential damages arising from the use or inability to use the Service. Our total liability to you shall not exceed the amount you have paid in the 30 days prior to the event giving rise to the damage.

All content, design, trademarks and software of CargaCell are the property of their respective owners and are protected by applicable intellectual property legislation. Reproduction, distribution or modification without prior written authorization is not permitted.

You may request deactivation of your account at any time from your profile. Historical transaction data is retained for the legally required period and may subsequently be deleted or anonymized in accordance with our Privacy Policy.

We reserve the right to modify these Terms at any time. We will notify significant changes with reasonable advance notice by email or through a notice on the platform. Continued use of the Service after the new Terms take effect implies their acceptance.

These Terms are governed by the applicable legislation in the jurisdiction where CargaCell operates. Any dispute that cannot be resolved amicably shall be submitted to the competent courts of said jurisdiction.
